Terms and Conditions of Flex Tiling

Welcome to Flex Tiling. By accepting a quotation, paying a booking fee, or allowing work to commence, the customer agrees to be bound by the following Terms and Conditions. Customers are advised to read these Terms carefully before proceeding.

1. Booking Fee and Payment

1.1 A booking fee may be required to secure diary time and confirm a start date. This booking fee covers administration, scheduling, project planning, and the reservation of availability, during which other work may be declined.

1.2 The booking fee is not a deposit. The booking fee is deducted from the final invoice unless otherwise stated in writing.

1.3 Where the customer enters into a contract at a distance or off premises, a statutory 14 day cooling off period applies unless work is scheduled to commence within that period.

1.4 If the customer cancels within the 14 day cooling off period and work has not been scheduled to begin, the booking fee will be refunded.

1.5 Where work is scheduled to commence within 14 days of booking, or where the cooling off period has expired, the booking fee becomes non refundable.

1.6 Cancellation within 14 days of the agreed start date may result in additional charges where Flex Tiling has incurred costs or loss of booked diary time.

1.7 The remaining balance is payable in full on the day of completion of the works, unless otherwise agreed in writing prior to the start date. Late payment may result in suspension of any ongoing or future work and may incur interest in accordance with applicable legislation.

2. Scope of Work

2.1 The scope of work will be defined in the written quotation provided by Flex Tiling.

2.2 Any work not expressly included within the quotation is excluded unless agreed as a variation in writing.

2.3 Flex Tiling undertakes tiling, preparation, waterproofing, bathroom installation, and associated plumbing works as agreed within the quotation.

2.4 Unless expressly stated in writing, Flex Tiling provides labour only. Tiles, sanitaryware, fixtures, fittings, and decorative finishes are supplied by the customer. Where materials are supplied by the customer, Flex Tiling accepts no responsibility for defects, delays, incompatibility, or performance of those materials.

3. Variations to Scope

3.1 Any changes to the agreed scope, materials, layout, or method after acceptance of the quotation will be treated as a variation.

3.2 Variations must be priced and agreed before additional work is undertaken.

3.3 Variations may affect programme, costs, and completion dates.

4. Access and Working Environment

4.1 To deliver work safely and to a high professional standard, Flex Tiling requires reasonable and uninterrupted access to the agreed work area. Once work has commenced, the work area will be treated as a controlled working environment for the duration of the installation.

4.2 Customers engage Flex Tiling for professional expertise and experience. All decisions relating to installation methods, preparation, waterproofing, fixing systems, sequencing, and technical detailing will be determined by Flex Tiling in accordance with industry standards and best practice.

4.3 Flex Tiling is entitled to work in a safe, respectful, and reasonably peaceful working environment. Occasional questions or discussion are welcome. However, repeated interruption, close supervision, aggressive behaviour, excessive noise, or attempts to direct or alter agreed methods during installation may affect safety, quality, and programme.

4.4 Flex Tiling reserves the right to pause work where the working environment becomes disruptive, hostile, or prevents reasonable progress.

4.5 If access to the work area is restricted, work is repeatedly stopped by the customer, or the working environment prevents reasonable progress, any resulting delays or additional costs may be chargeable. Where continued restriction or interference makes completion impractical, Flex Tiling reserves the right to suspend or terminate the contract. Payment will be due for work completed and materials ordered up to that point.

5. Professional Standards and Workmanship

5.1 All work is carried out with reasonable care and skill and in accordance with relevant British Standards.

5.2 Flex Tiling determines the correct installation methods, materials, and sequencing required to deliver a compliant and durable finish.

5.3 A workmanship guarantee of 12 months applies from the date of completion. This covers defects arising directly from installation.

5.4 The workmanship guarantee applies only where the work has been completed by Flex Tiling and paid for in full.

5.5 Materials, products, and fittings are subject to the manufacturer’s warranty only. Flex Tiling does not provide warranty for materials unless explicitly supplied and specified in writing.

5.6 Flex Tiling prepares surfaces to industry standards. However, underlying structural movement, inadequate construction, or pre existing defects may affect the performance of the finished installation. Flex Tiling cannot be held responsible for failure caused by such conditions where they are outside reasonable control.

5.7 Flex Tiling may recommend or install proprietary systems, including waterproofing and preparation systems. These systems are installed in accordance with manufacturer guidelines. However, long term performance is subject to correct use, building conditions, and manufacturer warranties.

6. Health and Safety

6.1 The customer must ensure that the work area is safe, accessible, and free from hazards prior to commencement.

6.2 Flex Tiling will comply with all relevant health and safety regulations while carrying out the works.

6.3 Any known hazards must be disclosed prior to commencement.

7. Asbestos

7.1 For properties constructed prior to the year 2000, asbestos may be present.

7.2 If asbestos is discovered or suspected, work will cease immediately.

7.3 The customer is responsible for arranging surveys, testing, and any required removal or containment.

7.4 Flex Tiling will not disturb asbestos containing materials without appropriate certification and controls.

7.5 Any delays or additional costs resulting from asbestos are the responsibility of the customer.

8. Insurance and Liability

8.1 Flex Tiling holds appropriate insurance cover for the works undertaken.

8.2 Flex Tiling shall not be liable for loss or damage arising from pre existing defects, third party work, or customer supplied materials unless caused by negligence.

8.3 Flex Tiling shall not be responsible for failure of pre existing pipework, fittings, or installations uncovered during the works unless damage is caused by negligence.

8.4 To the fullest extent permitted by law, Flex Tiling’s liability is limited to the value of the contract. Flex Tiling shall not be liable for any indirect, consequential, or financial losses.

9. Fees, Pricing and VAT

9.1 All prices are confirmed in writing.

9.2 Late payments may incur reasonable interest in line with applicable legislation.

9.3 Payment is to be made by bank transfer unless otherwise agreed.

9.4 Flex Tiling is not currently VAT registered. VAT is charged on materials supplied where applicable.

10. Cancellation and Termination

10.1 The customer may cancel in writing at any time.

10.2 Where cancellation occurs after work has commenced or materials have been ordered, costs incurred to date remain payable.

10.3 Flex Tiling reserves the right to suspend or terminate works where contractual obligations are breached.

11. Force Majeure

Neither party shall be liable for delay or failure caused by circumstances beyond reasonable control, including but not limited to extreme weather, illness, supply chain disruption, or government restrictions.

12. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
